This Privacy Notice provides you with information about what personal data we collect about you, how and why we use it, with whom we share it, how we store it, and your rights with respect to your data. This Privacy Notice is meant to be read together with our Terms of Service ("Terms"), which you can find at https://www.colorsintelligence.com/marketplace/legal/terms.

We at Colors Intelligence AI Ltd. ("us", "we", or "our") recognize and respect the importance of maintaining the privacy of our customers and their end users. This Privacy Notice describes the types of information we collect from you when you visit our online platform connecting companies with suitable job candidates and service providers ("platform") and/or use our services thereon (such services, together with the platform, the "services"). Our platform serves several different types of users. Businesses looking for employees or service providers, job candidates who submit job postings, or service providers who promote their services to businesses. "You" means an individual using the services, whether as a (representative of a) business or a service provider, or as a job candidate and "personal data" means any information that refers, is related to, or is associated with an identified or identifiable individual or as otherwise may be defined by applicable law. This Privacy Notice details which personal data we collect when we provide the Services to you.

You have no legal obligation to provide us with any personal data. If you are subject to the laws of the State of Israel, note that any personal data you choose to provide is provided with your consent as required under applicable law. Note that if you do not provide us with certain personal data, we may not be able to provide you with some or all of the associated services. The services are intended primarily for users located in Israel. We do not target, market to, or otherwise direct the services to individuals in the European Economic Area at this time.

Personal Data We Collect

Communications. When you send us a message, sign up for our email list, complete online forms, or contact us for any other reason we collect any data you provide, such as your name, email, and the content of your message.

Registration Data. In order to use our services, you will be required to register and provide us with certain personal data, such as your name, email address, phone number, home address, age, gender, your resume (if applicable), and the company you work for (if applicable). If you access our platform using a third-party login service (such as Google), we also receive personal data about you from that third-party service, such as: Unique User ID (UID), full name, email address, profile picture URL, and language (location) preferences. The specific information we receive may vary depending on the third-party service and your privacy settings with that service. Please check such third-party’s policies in order to understand what information we receive.

Payment Information. If you make a purchase through the platform, you will be asked to provide us and/or our third party payment processor details regarding the payment instrument you choose to use, for example, your: name, phone number, credit card information, billing address, and ID number. In order to identify your transaction, we may receive a token from our third party payment processor, which serves as a unique identifier for the transaction, allowing us to track and manage the transaction, without directly holding your entire payment instrument data.

Resume Information. If you have a job candidate account, you will be asked to provide us with your resume and if you have a business account, you may post resumes you've received from potential job candidates to the platform. We collect all the information contained in these resumes.

Profile Information. Each user creates a profile on the platform, regardless of the type of account they've created. Your profile displays any data you choose to publish and may contain personal data, such as, your registration data (listed above in Section 1.2) including your age, gender, and home address, if you are a job candidate, your resume and personality questionnaires you have completed, and any other information you choose to upload. Your profile may be visible to other users, for example, if you are a job candidate, your profile may be shared with certain businesses offering open positions on the platform or recruiters for open positions and if you are a freelancer or vendor, your profile is visible to companies registered on our platform looking for services you offer.

Matches. If you are a job candidate, the platform will attempt to match your profile with open positions that businesses have submitted to the platform. The platform will use AI algorithms to assess each candidate's suitability to such open positions, comparing the candidate's profile with the job description and the business's internal criteria. The platform shares certain candidate profiles with a high degree of match with the applicable business. The match is shared as a percentage, along with an explanation for the score. The platform may also share insights regarding candidate profiles, for example, highlighting topics for further discussion during an interview. Note that the match score is assessed on the basis of each position posted. A candidate may get a different match score for two different positions even if they are with the same business. To be clear, our services are designed solely as a complementary tool to assist in recruiting operations. Each business is responsible for performing a human review of all job candidate profiles we share. The decision whether or not to hire any candidate rests solely with the applicable business.

CV AI. If you are a job candidate, you may use our proprietary CV AI platform that drafts a resume for you based on your responses to questions it poses. The CV AI platform can also provide you with AI-generated insights regarding how to advance your career. We collect the content you submit to the AI chatbot, including your prompts, responses to the chatbot's questions, any files you may upload, and the output generated through the tool, such as draft resumes, suggested edits, versions you choose to save, as well as any output related to your career trajectory.

Activity and System Data (including Cookies). In addition, when you use the platform, we may gather certain information automatically about your computer or mobile device, such as your operating system, your IP address, device ID, as well as your browsing history (e.g. the other sites you've visited before ours) and any other information regarding your use, viewing, and activity history on our platform. This data is also collected via cookies (for more information, see cookies section below).

How We Use Your Personal Data

General. We and any of our trusted third-party subcontractors and service providers use the personal data we collect from and about you for any of the following purposes: (1) to provide you with the services; (2) to respond to your inquiries or requests, contact and communicate with you; (3) to develop new products or services and conduct analyses to improve our current content, products, and services; (4) to contact you with informational newsletters and promotional materials relating to our platform and services; (5) to review the usage and operations of our platform and services; (6) to use your data in an aggregated, non-specific format for analytical purposes (as detailed below); (7) to prevent fraud, protect the security of our platform and services, and address any problems with the platform and/or services; (8) to provide customer support; and (9) to defend our rights or the rights of others.

Profile Information and Match Scores. We use the profile information we collect, as well as the match scores and related insights to provide our services to our users. Your registration to our platform and use of our services constitutes your consent to share your profile information with the relevant users on the platform.

CV AI Data. In addition to using the personal data you submit to and generate using CV AI to provide you with the services, we also use such personal data in a de-identified manner to improve our services generally.

Statistical Information and Analytics. We and/or our service providers use analytics tools to collect and analyze information about the use of the services, such as how often users visit the platform, what pages they visit when they do so, and what other sites and mobile applications they used prior to visiting the platform. By analyzing the information we receive, we may compile statistical information across a variety of platforms and users. This helps us improve our services by allowing us to identify new trends and customer needs, which in turn allows us to consider new products and services or tailor existing products and services accordingly.

Sharing the Personal Data We Collect. We share your information, including personal data, as follows:

Our Personnel. We share personal data with certain of our personnel who have a need to know and process personal data in accordance with this Privacy Notice, and who are bound by confidentiality obligations towards us. It is hereby clarified that the identity and/or type of such access-holders may change from time to time in accordance with our business needs. In case there is a material change in the types of access-holders, we will use commercially reasonable efforts to update you about such change.

Customers. If you use our services in connection with a company that is our customer, that customer may have access to information about your use of our services. For example, a user with an administrator account may be able to see your data.

Registered Businesses. If you are a job candidate, freelancer, or vendor user, we share your personal data with the relevant businesses registered to our platform as part of our provision of services to you. Please note that such entities process your personal data for their own purposes, in accordance with the use restrictions we've included in our Terms of Service for businesses, including using such personal data solely to evaluate each candidate's suitability for the relevant position. We also obtain contractual obligations that such users process your personal data in accordance with applicable law. You further acknowledge that deleting your account will stop future sharing through the platform but will not affect information already shared with a registered business, which may retain and use it in accordance with its own privacy notice and applicable law. If you have engaged a business, you may review such business's privacy notice for more information on how they further process your personal data, unrelated to the platform, or contact the business directly.

Service Providers and Subcontractors. We disclose information, including personal data we collect from and/or about you, to our trusted service providers and subcontractors, who use such information to: (1) help us provide you with the services, including data storage/cloud hosting and AI tools; and (2) aid in their understanding of how users are using our services.

International Transfers. By accepting this Privacy Notice, you acknowledge and agree that we may use subcontractors and service providers who are located in countries other than your own and may send them information we receive (including personal data). All of our subcontractors and service providers will be subject to non-disclosure and non-use obligations.

Business Transfers. Your personal data may be disclosed as part of, or during negotiations of, any merger, sale of company assets or acquisition (including in cases of liquidation). In such case, your personal data shall continue being subject to the provisions of this Privacy Notice.

Law Enforcement Related Disclosure. We may share your personal data with third parties: (i) if we believe in good faith that disclosure is appropriate to protect our or a third party's rights, property or safety (including the enforcement of the Terms and this Privacy Notice); (ii) as is necessary to comply with any legal and/or regulatory obligation; or (iii) when required by subpoena, court order or the order of another governmental or law enforcement authority.

Legal Uses. We may use your personal data as required or permitted by any applicable law, for example, to comply with audit and other legal requirements.

Other Uses or Transfer of Your Personal Data. If you use our platform and/or services with or through a third-party service, site and/or mobile application, we may receive information (including personal data) about you from those third parties. Please note that when you use third parties outside of our platform and/or services, their own terms and privacy policies will govern your use of those services.

Security. We make efforts to follow generally accepted industry standards to protect the personal data submitted to and collected by us, both during transmission and once we receive it. However, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security. As the security of information depends in part on the security of the computer you use to communicate with us and the security you use to protect user IDs and passwords, please take appropriate measures to protect this information.

Your Rights. Subject to applicable law, you may request to access any personal data you have provided to us and request that such personal data be corrected, updated, or deleted, including in accordance with Articles 13 and 14 of the Israeli Privacy Protection Law, 1981. You may exercise such rights by emailing us at colorsservicehr@gmail.com.

Data Retention. Subject to applicable law, we retain personal data as necessary for the purposes set forth above and then delete the personal data once we deem it is no longer necessary for these purposes. In some circumstances, however, we may store your personal data for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, audit, accounting requirements and so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your personal data or dealings.

Cookies and Similar Technologies. We use cookies and similar technologies for a number of reasons, including to help personalize your experience. When visiting this platform, you shall be notified of the use and placement of cookies and other similar technologies on your device as specified herein.

What are Cookies? A cookie is a small piece of text that is sent to a user's browser or device. The browser provides this piece of text to the device of the originating user when this user returns.

A "session cookie" is temporary and will remain on your device until you leave the platform.

A "persistent" cookie may be used to help save your settings and customizations across visits. It will remain on your device until you delete it.

First-party cookies are placed by us, while third-party cookies may be placed by a third party. We use both first- and third-party cookies.

We may use the terms "cookies" to refer to all technologies that we may use to store data in your browser or device or that collect information or help us identify you in the manner described above, such as web beacons or "pixel tags".

How We Use Cookies. We use cookies and similar technologies for a number of reasons, as specified below.

Performance/AnalyticsThese cookies can help us collect information to help us understand how you use our platform, for example whether you have viewed messages or specific pages and how long you spent on each page. This helps us improve the performance of our platform.

How to Adjust Your Preferences. Most web browsers are initially configured to accept cookies, but you can change this setting so your browser either refuses all cookies or informs you when a cookie is being sent. In addition, you are free to delete any existing cookies at any time. Please note that some features of the services may not function properly when cookies are disabled or removed. For example, if you delete cookies that store your account information or preferences, you will be required to input these each time you visit.

Third-Party Applications and Services. All use of third-party applications or services is at your own risk and subject to such third party's terms and privacy policies. We do not take any responsibility for the performance of other services.

Communications. We reserve the right to send you service-related communications, including service announcements and administrative messages, without offering you the opportunity to opt out of receiving them. Should you not wish to receive such communications, you may cancel your account.

Children. We do not knowingly collect personal data from children under the age of eighteen (18). In the event that you become aware that an individual under the age of eighteen (18) has enrolled without parental permission, please advise us immediately.

Changes to the Privacy Notice. We may update this Privacy Notice from time to time to keep it up to date with legal requirements and the way we operate our business, and we will place any updates on this webpage. Please come back to this page every now and then to make sure you are familiar with the latest version. If we make material changes to this Privacy Notice, we will seek to inform you by notice on our platform or via email.
